Independent forensic Ukraine needs to reform the legislation. It is necessary to consolidate the equality of legal experts of public and private forensic expert institutions that will in practice provide competition in this market and guarantee the principle of adversarial proceedings.
The concept of independent forensics Ukraine is determined by the extremely wide range of the most diverse research carried out in cases where during the pre-trial and trial requires special knowledge in science, technology, art or craft, to discover and learn the hidden essence of phenomena and things and give their scientific interpretation. At its core, expert knowledge is kind of knowledge of particular facts. It is based on the same principles as any other kind of knowledge during the investigation and trial. However, it is not only its procedural form, but not least, means and methods.
Independent forensic Ukraine, namely the expert study – a complex process in which some of its stages are interrelated and interdependent. In this regard, from a methodological point of view, this process can only provide the basic elements that form the stage of expert research.
Expert research consists of the following stages:
Previous studies.
Separate research.
Expert experiment.
Comparative study.
Evaluation of the survey results and drawing conclusions.
Making expert study.
Depending on the type of tasks to be solved by expert research, expert stage of experiment and comparative studies may be available.
Consistency of application of research methods and means determined by an expert in accordance with certain methods of research. The expert should use non-destructive methods, unless as a result of their use can not be achieved the goal of the study.
